Terms of Service

These terms are an agreement between you (the business using RootChat, the “client”) and Brainroot Digital, which operates RootChat. By using RootChat you agree to them.

1. The service

RootChat is an online dashboard that connects to your messaging channels (Facebook Messenger, Instagram, WhatsApp and website chat), uses AI to reply to your customers, and helps you manage products, orders, couriers, payments and customers. Features depend on your plan.

2. Your account

• Keep your login details safe and tell us at once if you think someone else has used your account.
• You are responsible for what your team members do in your account.
• The information you give us must be true and kept up to date.

3. Plans and payment

• Plans are charged monthly in Bangladeshi taka at the price shown when you subscribe. Each plan includes a monthly amount of AI credit and order SMS; extra credit and SMS can be bought.
• Unused monthly AI credit and plan SMS do not carry over to the next month.
• If a payment is not made, we may pause the service after giving notice.
• We may change prices with at least 30 days' notice; the new price applies from your next billing month.

4. Acceptable use

You must not use RootChat to:

• sell illegal, counterfeit or prohibited goods or services;
• send spam, or message people who have not contacted you or agreed to hear from you;
• mislead, harass or discriminate against anyone;
• break the Meta Platform Terms, WhatsApp Business policies, or Bangladeshi law;
• try to access other clients' data or attack the service.

We may suspend accounts that break these rules.

5. AI replies

The AI replies using the products, prices and information you provide. You are responsible for keeping that information correct and for the offers you make to your customers. AI can make mistakes; you can review and take over any conversation at any time. Order totals are calculated by the system from your product prices, campaigns and coupons.

6. Third-party services

RootChat connects to services run by others, such as Meta (Facebook, Instagram, WhatsApp), OpenAI, SMS providers and courier companies. Their own terms apply, and we are not responsible for their outages, policy changes or decisions (for example, Meta limiting a Page).

7. Your data

You own your data: your products, orders, customers and messages. You give us permission to process it only to provide RootChat to you, as explained in our Privacy Policy. You are responsible for having the right to collect your customers' data and for answering their requests.

8. Availability and changes

We work to keep RootChat running at all times but cannot promise it will never be interrupted. We may improve, change or remove features; if we remove a major paid feature, we will tell you in advance.

9. Limitation of liability

To the extent allowed by law, RootChat is provided “as is”, and our total liability for any claim is limited to the amount you paid us in the three months before the claim. We are not liable for lost profits or indirect losses.

10. Ending the service

You may stop using RootChat at any time by telling us. We may end the service with 30 days' notice, or at once for a serious breach of these terms. After the account is closed, your data is deleted as described in the Privacy Policy.

11. Law

These terms are governed by the laws of Bangladesh, and disputes will be handled by the courts of Dhaka.
